A consumer court fined a hotel owner ₹1,000 for offering biryani to a hotel owner who offered kushka. Also, ordered to refund of ₹150 biryani to the customer.
On April 2, 2023, Krishnappa, a resident of Nagarabhavi, brought a parcel of biryani from Hotel Prashant in ITI Layout after running out of cooking gas at home.
When he came home and opened the parcel, there was no chicken piece in the biryani he had ordered. Krishnappa called the owner of Hotel Prashant to inquire about this and informed him. Later, the hotel owner said that he would send another biryani home.
Believing this, the Krishnappa couple have been waiting for almost two hours without eating. Kushka spent the night eating the chicken biryani even though it did not come.
On April 28, Krishnappa told the hotel owner that he would take legal action against the wrongdoing. However, the owner seems apathetic and remains silent.
Krishnappa had filed a complaint against the hotel owner in Bengaluru City District Consumer Disputes Redressal Commission in Shantinagar in May, demanding compensation of ₹30,000 from the owner of Prashant Hotel.
The hotel owner did not appear in court. Krishnappa himself, who is a lawyer, argued in the court.
“The hotel owner took full payment for biryani from the customer and gave the wrong parcel. This is a mistake either knowingly or unknowingly. Even though the customer informed the hotel owner about this, the replacement biryani parcel was not given. The hotel owner has failed to provide good service to the customers. Therefore, ₹1000 compensation should be given for the mistake along with ₹150 paid for biryani,” the consumer court judge ordered on 5th of 2023.
