Delhi special Court orders release of student activists Nariwal, Kalita and Asif Tanha

Delhi special court on Thursday issued release warrants of Pinjara Tod activists Natasha Narwal, Devangna Kalita, and Jamia student Asif Iqbal Tanha. These student activists had moved to the High Court to seek immediate release from jail after being granted bail in the Delhi riots case on June 15.

A Division Bench led by Justices Siddharth Mridul and Anup Jairam Bhambhani granted bail to the trio on June 15 after furnishing a personal bond of Rs 50,000 each and two local sureties of each.

Advocate Sidharth Aggarwal who appeared for the alleged, which was submitted that the bail order passed on June 15, has still not been implemented.

Special Public Prosecutor Advocate Amit Prasad submitted that they were only following the orders of the court.”The address of the appellants was to be verified. Addresses provided to us are of different states. We don’t have magical powers that we will verify all of this, addresses in Jharkhand, Assam in such a short time. That’s why the application seeking more time to verification procedure was moved,” said SPP Amit Prasad.

The courts also dismissed the applications filed by Delhi police, asking more time for verifying the addresses of these activitists and their sureties. The order came after Delhi High Court granted bail to student activists Nariwal, Kalita and Tanha. The trio were in custody from May last year under the stringent Unlawful Activities Prevention Act(UAPA), connected with northeast Delhi violence cases.

The Bench of Justice Sidharth Mridul and Justice Anup Jairam Bambhani, noting the submission of both sides, said, “let the trial court decide the application” (which is expected to pass shortly) and passed an order on that. “We can put these matters for later in the afternoon to be apprised of.”

The High Court said it would again take up the matter at 3.30 PM. The trial court is expected to proceed further with promptitude and expedition to decide the issue, the Bench said.
