Kerala Court Sentences Man to Three Life Terms for Sexual Assault on Minor Daughter

A man in Kerala has been handed three life sentences for repeatedly sexually assaulting his six-year-old daughter in July of last year.

The Thiruvananthapuram Fast Track Special Court (FTSC) judge R Rekha sentenced the man to life imprisonment for each of the offenses under sections 5(l), 5(m), and 5(n) of the POCSO Act, which pertains to penetrative sexual assault on a child, particularly below 12 years of age, and sexual assault of a child by a relative.

Confirming the sentence, special public prosecutor (SPP) R S Vijay Mohan stated that the father also received additional sentences under various provisions of the Protection of Children from Sexual Offenses Act (POCSO) and the IPC, totaling 21 years. Additionally, the court imposed a fine of Rs 90,000 on the 40-year-old father.

Despite the multiple sentences, as they are to be served concurrently, the man will effectively serve a life sentence, the prosecutor noted.

In its sentencing order, the court remarked on the disgraceful betrayal of fatherhood trust by the defendant, emphasizing that a father’s duty to protect his daughter was gravely violated.

Furthermore, the court expressed that such heinous acts irreparably rob the victim of her childhood innocence and cannot be justified.

The assault occurred in July 2023 while the victim’s mother was working abroad, leaving the girl in the care of her father and maternal grandmother. The child was assaulted during her stay with her father and lured into a room under the pretense of showing her a mobile phone.

Upon experiencing pain, the child confided in her grandmother, who promptly sought medical attention. The doctor was informed of the assault, leading to police involvement and subsequent legal action.

Additionally, the victim’s 15-year-old sister testified in court, detailing inappropriate behavior by the father, particularly when intoxicated.

The trial commenced on March 29, 2024, and concluded within a month, according to the SPP.
