Centre Likely to Amend BNS to Include Provisions on Sexual Crimes Against Men and Transgender People

As three new criminal laws come into effect nationwide starting Monday, despite objections from Opposition-ruled States, Union government officials have clarified that States are free to amend certain provisions of the Bharatiya Nagrik Suraksha Sanhita (BNSS), which replaces the Code of Criminal Procedure (CrPC). The BNSS outlines the procedures and conditions for arrest, bail, and custody, among other aspects.

Additionally, the Bharatiya Nyaya Sanhita (BNS), which replaces the Indian Penal Code of 1860, may soon be amended by the Union government to include a missing section on sexual crimes against men and transgender persons.

A senior government official mentioned that, until this amendment is made, police officers are being instructed to use other relevant sections under the BNS, such as those about wrongful confinement and physical harm, when handling such complaints.
